Minder Legal
Practitioner Agreement
Responsibilities for providing care and running a practice through Minder.
Version:
Your relationship with Minder and clients
This agreement supplements the Terms of Service for practitioners using Minder’s tools. Minder is currently an unregistered project operating from Armenia. This page does not establish a corporate contracting entity, employment relationship, or clinical partnership. You remain responsible for the services you agree with each client and for identifying yourself as their provider.
Qualifications and scope of practice
Provide accurate qualifications, role, experience, location, fees, and availability. Practise only within your competence and legal authorization in the relevant locations, including the client’s location for remote care. Obtain required registrations, supervision, insurance, and permissions where applicable. Inform Minder promptly of expired, suspended, restricted, or disputed credentials. A verification badge is not a licence to practise.
Trainees and supervised practitioners must describe their status accurately and arrange appropriate supervision. Do not imply an unrestricted licence, diagnose or prescribe outside your permitted scope, or guarantee recovery. Clinical decisions must remain independent of marketplace rankings or financial incentives.
Client agreement and informed consent
Before the first service, explain and document the nature and limits of care, fees and cancellation rules, communication expectations, confidentiality exceptions, emergency arrangements, and any third-party involvement. Obtain the necessary informed consent and revisit it when care changes. Platform registration and video notices do not replace your clinical consent process.
Check identity and the client’s current location when needed for lawful and safe care. For minors, representatives, couples, or groups, verify who may consent, who is the client, and who may access records. Obtain permission before inviting another participant. Do not assume a shared booking or group invitation authorizes disclosure of each participant’s clinical information.
Risk, emergencies, and continuity of care
Assess whether remote care is appropriate. Agree an emergency plan and appropriate local contacts with the client, and explain when confidentiality may lawfully be limited. Minder messages and support are not continuously monitored crisis channels. Use appropriate local emergency or referral services when required.
If you stop practising, lose access, or end a therapeutic relationship, arrange appropriate notice, referral, record handling, and continuity of care consistent with your professional duties. Platform suspension does not remove those duties.
Confidentiality and clinical records
You are responsible for the purpose, accuracy, lawful collection, disclosure, and applicable retention of the clinical records you create. Minder operates platform infrastructure and has its own privacy obligations. Roles depend on the actual service and must be documented; this agreement alone is not a complete data-processing agreement.
Use your own account, restrict access to authorized people, secure devices, and share the minimum necessary information. Do not place identifiable client details in public posts or public translation tools. Do not upload clinical notes or private conversations to external AI services without a lawful basis, appropriate client information, and approved safeguards. Report suspected unauthorized access to support promptly without including unnecessary clinical material in email.
Do not record, screenshot, or distribute a session without the necessary explicit permission and lawful safeguards. Explain confidentiality limits in couples and group work. Handle access, correction, transfer, and deletion requests with Minder where platform data is involved, while respecting legally required retention. Account deactivation is not deletion of clinical records.
Payments, refunds, and taxes
Disclose prices and payment instructions before commitment. Record payments honestly and verify receipts; do not mark unpaid sessions as paid or refunds as sent before transferring funds. Session payments and refunds are currently direct arrangements with you. Complete refunds you owe and provide appropriate evidence of transfer. You remain responsible for applicable invoicing, tax, and accounting obligations.
Use the cancellation rules disclosed for the booking and respect mandatory consumer rights. A platform balance, supervision credit, or ledger figure is not a bank deposit or a promise of cash withdrawal. Any future platform fee or payment-processing arrangement must be disclosed and agreed before it applies.
Organizations, referrals, and supervision
Confirm your authority and duties when working for an organization or funded program. A referral does not authorize unrestricted access to a client’s records. Obtain a lawful basis for sharing referral details and distinguish service reporting from optional outcome tracking. Do not disclose identifiable clinical notes to sponsors, donors, or supervisors without the required authority and safeguards.
Complaints, restrictions, and agreement changes
Cooperate with proportionate investigations of safety, credential, payment, and privacy concerns. Minder may restrict platform access where needed to protect users or meet legal obligations. Ask support for review where appropriate. Respond to clients’ complaints professionally, preserve relevant records lawfully, and honour refunds and continuity obligations after access ends.
Acceptance records identify the version accepted and the account that accepted it. Existing practitioners are not treated as having accepted a new version merely because it was published. This agreement does not replace an organization contract, a client treatment agreement, a required data-processing agreement, or any mandatory professional obligations.
